About these terms
These Terms of Service govern your use of villaltaco.uk. The site is operated by Villalta Home Co., an individual online retailer trading from the United Kingdom and serving customers across the UK. The contact address for any matter relating to these terms is support@villaltaco.uk.
If you do not agree with these terms, please do not use the site. We may update them from time to time; the version published at this URL is the version that applies to your use of the site at the time of your visit.
Orders and contract formation
Listings on villaltaco.uk are an invitation to treat, not a binding offer. Submitting an order on the checkout page is your offer to buy the listed items at the displayed price. The contract is formed when we send the order confirmation email confirming that the order has been accepted and payment has been received.
We may decline or cancel an order, refunding any amount paid, in cases such as obvious pricing errors, payment problems, suspected fraud, stock unavailability or restrictions imposed on the destination. If we cancel an accepted order, we will explain the reason in writing.
Prices, taxes and payment
All prices on the site are shown in pounds sterling (GBP). UK applicable taxes, when relevant, are included in the listed price. Shipping costs are calculated and shown separately at checkout, before payment is taken.
Payments are processed by Stripe. Card details are never stored on our servers. By placing an order you authorise Stripe to charge the total amount shown at checkout.
Delivery
Estimated delivery times are shown on the product page and on the Shipping Policy. Estimates depend on the supplier and the destination and may extend during peak periods.
Risk and ownership of the goods pass to you when they are delivered to the address you provided at checkout.
Cancellation, returns and consumer rights
If you are a consumer based in the UK, you have a statutory right to cancel under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013. You may cancel within 14 calendar days of receiving the goods under that statutory right. As a goodwill commitment, our Returns Policy extends that window to 30 calendar days. Some products are excluded by law (for example items made to your specifications, sealed health or hygiene goods after their seal has been broken, or perishables).
Specific procedures, deadlines and conditions for returns are described in the Returns Policy and prevail over this section in case of conflict.
Liability
Nothing in these terms limits or excludes our liability for death or personal injury caused by negligence, for fraud, or for any other liability that cannot be limited or excluded under applicable UK law, including the Consumer Rights Act 2015.
Subject to the previous paragraph, our total liability for any direct loss connected to a single order is limited to the amount you paid for that order. We are not liable for indirect or consequential loss such as loss of profit, loss of business or loss of opportunity.
Governing law and jurisdiction
These terms are governed by the laws of England and Wales. Disputes will be submitted to the exclusive jurisdiction of the courts of England and Wales, except where mandatory consumer protection law in your country of residence gives you the right to bring proceedings before a different forum.
